Terms of Service

1. Acceptance of Terms

By accessing or using SuuqBay ("the Platform"), operated by SuuqBay ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all visitors, users, and others who access or use the Platform.

We reserve the right to update or modify these Terms at any time. Your continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify registered users of significant changes via email or in-platform notification.

2. Account Registration

To access certain features of the Platform, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

You must be at least 18 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent.

3. User Responsibilities

As a user of SuuqBay, you are responsible for:

• Ensuring all information you provide in listings is truthful and not misleading
• Conducting transactions in good faith and honouring commitments made to other users
• Complying with all applicable local, national, and international laws
• Communicating respectfully and honestly with other users on the Platform
• Resolving disputes with other users in a fair and reasonable manner

4. Listing Policies

When creating a listing on SuuqBay, you agree to the following:

• You must have the legal right to sell or offer the listed item or service
• Listings must accurately describe the item or service, including condition, price, and any defects
• Images must represent the actual item being offered and must not be misleading
• Pricing must be clearly stated and must not involve hidden fees or deceptive practices
• Listings must be placed in the appropriate category
• Duplicate listings for the same item are not permitted

We reserve the right to remove any listing that violates these policies without prior notice.

5. Prohibited Content and Activities

The following content and activities are strictly prohibited on SuuqBay:

• Stolen goods or items obtained through illegal means
• Counterfeit, replica, or pirated products
• Illegal drugs, controlled substances, or drug paraphernalia
• Weapons, ammunition, or explosives
• Hazardous materials
• Content that is defamatory, obscene, abusive, or violates the rights of others
• Spam, phishing attempts, malware, or any form of fraudulent activity
• Any item or service that violates local, national, or international law
• Harvesting or collecting user information without consent
• Interfering with or disrupting the Platform or its servers

Violations may result in listing removal, account suspension, or permanent ban, and may be reported to relevant authorities.

6. Intellectual Property

The Platform and its original content (excluding user-generated content), features, and functionality are owned by SuuqBay and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

By posting content on SuuqBay, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content in connection with operating and promoting the Platform. You retain all ownership rights to your content.

You may not use SuuqBay's name, logo, or branding without our prior written consent.

7. Transaction Disclaimer

SuuqBay is a classifieds platform that connects buyers and sellers. We are not a party to any transaction between users. Therefore:

• We do not guarantee the quality, safety, legality, or availability of items listed
• We do not guarantee the truthfulness or accuracy of listings or user content
• We are not responsible for the behaviour of any user on or off the Platform
• Users are solely responsible for assessing the suitability and legitimacy of transactions

We strongly recommend meeting in safe, public locations when conducting in-person transactions and exercising caution when transacting online.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SuuqBay and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, goodwill, or other intangible losses
• Any unauthorised access to or use of our servers or personal information stored therein
• Any interruption or cessation of transmission to or from the Platform
• Any bugs, viruses, or similar issues transmitted through the Platform by any third party
• Any errors or omissions in any content posted or transmitted through the Platform

9. Dispute Resolution

If you have a dispute with another user, we encourage you to resolve it directly. SuuqBay may, at its sole discretion, offer mediation assistance but is under no obligation to do so.

For disputes between you and SuuqBay, you agree to first attempt to resolve the matter informally by contacting us. If the dispute cannot be resolved informally within 30 days, either party may pursue formal proceedings in accordance with the governing law section below.

10. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may do so through your account settings or by contacting us.

All provisions of the Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Somalia, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
